Terms of Service

1. Acceptance of the service

By accessing or using Sailgio, you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform.

2. Accounts

You are responsible for the accuracy of the information provided when creating or using your account, and for maintaining the confidentiality of your login credentials. You are also responsible for all activity carried out through your account, unless such activity results from a security issue attributable to Sailgio.

3. Services, plans and access levels

Sailgio provides access to AI tools under different account levels, including Free, Creator, Pro and VIP. Each plan may include different usage limits, features, file upload permissions, voice clone access, priority level, result retention periods, included monthly Vifies, rollover rights and optional extra pack eligibility.

Current plan features, limits, Vify balances, extra pack prices and validity periods are described on the pricing page. In case of conflict between a general description and the pricing page, the pricing page in force at the date of purchase or renewal prevails for the applicable commercial conditions.

4. Vifies, packs and consumption rules

Vifies are usage credits consumed when you launch eligible tools or paid operations on Sailgio. The cost of a job may depend on the duration of the media processed, the amount of text submitted, and optional features such as voice clone, media file processing or logo removal.

Unless stated otherwise on the pricing page or at checkout:

• included monthly Vifies are linked to the current billing cycle of the relevant plan;
• monthly rollover, where available, is limited, non-cumulative and valid for one following cycle only;
• extra packs remain separate from the monthly allowance and each purchased pack is treated as an independent lot with its own expiration date;
• when several credit sources coexist, Sailgio consumes credits in the order displayed on the pricing page and inside the user account;
• for plans with pack expiration priority logic, Sailgio may consume the pack that expires first before later-expiring packs.

Vifies have no cash value, are non-transferable except where Sailgio expressly allows a plan-based conversion, and may not be resold, assigned or exchanged outside the platform.

5. Payments, subscriptions and renewals

Paid plans, subscriptions and extra Vify packs may be billed through third-party payment providers such as Stripe. By purchasing a paid plan or extra pack, you authorize the applicable payment method to be charged for the corresponding amount, including recurring billing where the selected offer renews automatically until cancellation.

Unless expressly stated otherwise at checkout, paid subscriptions renew automatically for successive billing periods. You may cancel renewal from your account area at any time for the following billing cycle. Cancellation does not normally retroactively cancel the current period already started.

Prices, plan structures, included balances, commercial benefits and extra pack rules may change over time. However, such changes do not retroactively alter rights already validly acquired for an already-paid current period, except where required by law or necessary for security, fraud prevention or service continuity.

6. Consumer right of withdrawal and immediate performance

If you are a consumer benefiting from mandatory withdrawal rights under applicable law, you may in principle have a right to withdraw within fourteen (14) days from the conclusion of the distance contract, unless a legal exception applies.

Because Sailgio provides digital services and may also provide digital content without physical medium, you may be asked at checkout or before first paid use to expressly request immediate performance before the end of the withdrawal period.

If you expressly request immediate access, activation, execution of a paid tool, generation of paid output, consumption of paid Vifies, or any other immediate paid digital performance before the end of the withdrawal period:

• you expressly request that Sailgio begin performance immediately before the end of the withdrawal period;
• you acknowledge that, where the law so provides, you may lose your right of withdrawal once performance has begun for digital content supplied without a tangible medium;
• for digital services or subscriptions that are not yet fully performed at the date of withdrawal, Sailgio may retain or invoice an amount proportionate to the service already supplied before the withdrawal request, including objective usage elements such as activated access, elapsed paid period, Vifies already consumed, started paid jobs, generated paid outputs, or other measurable executed service components.

Where the law requires it, loss of the withdrawal right for immediately supplied digital content applies only if Sailgio has collected your express prior consent, your acknowledgement that you lose the right of withdrawal, and has provided the relevant confirmation on a durable medium.

For clarity, the launch of a paid tool or the consumption of paid Vifies before the end of the withdrawal period is treated by Sailgio as a request for immediate execution of the corresponding paid digital performance. Depending on the legal qualification of the relevant supply, this may either:

• eliminate the right of withdrawal for the relevant digital content once execution begins, where the legal conditions are met; or
• reduce any refund to a proportional amount for the service already provided before withdrawal.

If you do not wish performance to begin before the end of the withdrawal period, you should not request immediate activation, should not launch paid tools, and should not consume paid Vifies during that period.

7. Refund policy outside withdrawal rights

Except where mandatory law provides otherwise, purchases of subscriptions, used billing periods, consumed Vifies, started paid jobs, generated paid outputs and expired packs are non-refundable.

Sailgio may, at its sole discretion and without creating any obligation for the future, grant a commercial gesture, partial refund, account credit or corrective balance adjustment in justified cases such as duplicate billing, obvious technical malfunction attributable to Sailgio, or proven payment error.

8. User content, generated output and intellectual property

You retain, to the extent permitted by law, your rights in the content you lawfully upload or submit to Sailgio. You represent that you have all rights, permissions and legal bases necessary to submit, process, transform or generate content through the platform.

Sailgio and its licensors retain all rights in the platform, software, interfaces, branding, underlying models, workflows, databases and non-user elements of the service.

Generated output may depend on probabilistic systems, third-party models and technical constraints. Sailgio does not guarantee uniqueness, uninterrupted availability, legal suitability for your intended use, or absence of resemblance to third-party content.

9. Acceptable use

You agree not to misuse the platform, overload the service, attempt unauthorized access, bypass limits, scrape or reverse engineer restricted parts of the service, infringe third-party rights, or use Sailgio to process unlawful, fraudulent, abusive, defamatory, infringing, hateful, violent, deceptive or otherwise harmful content.

You must also comply with all applicable laws relating to privacy, copyright, personality rights, voice rights, image rights, data protection and the use of synthetic media.

10. Availability, storage and retention

Sailgio is provided on an as-available and as-evolving basis. Access, speed, priority, retention periods, generated file availability and processing quality may vary according to the selected plan, technical constraints, maintenance operations, abuse prevention systems, provider outages or model limitations.

Result retention periods, storage durations, monthly allowances, pack validity, rollover limits and freeze rules are those stated on the pricing page or in the applicable product interface at the relevant time. It is your responsibility to download and store any output you wish to keep before the applicable retention deadline.

11. Suspension and termination

Sailgio may suspend, restrict or terminate access in case of abuse, fraud, payment incident, excessive risk, legal claim, security issue, technical threat, violation of these Terms, or use likely to harm the platform, other users or third parties.

In such cases, Sailgio may also block access to stored outputs, freeze unused balances, refuse future purchases, or take any proportionate operational or legal measure reasonably necessary to protect the service.

12. Limitation of liability

To the maximum extent permitted by law, Sailgio shall not be liable for indirect, incidental, special, punitive or consequential damages, including loss of profit, loss of data, loss of opportunity, reputational harm or business interruption resulting from the use of, or inability to use, the platform.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under mandatory law, including mandatory consumer rights where applicable.

13. Changes to the service or the Terms

Sailgio may update the service, pricing structure, commercial rules and these Terms from time to time. The version in force at the time of your use or purchase applies, subject to mandatory legal protections. Continued use of the platform after an update means you accept the revised Terms.
